
The grandson and daughter-in-law of the decedent resident of a Maryland nursing home have filed a nursing home negligence lawsuit against the defendant nursing home. In the lawsuit, they allege that despite the fact that the 85-year-old woman needed medical attention, she was not given the attention she needed by the staff of the nursing home. The Events
The woman had a fracture of her left arm and dislocated right arm, the causes of both of which were not explained. Her daughter-in-law was present with her in the nursing home. For one hour, the daughter-in-law took a video as evidence of the pain her mother-in-law was suffering, and of the failure of the nursing home’s staff to respond, despite the call light used to request assistance had been activated. The woman died thirty hours later.
The medical records for the nursing home state that the resident was resting and did not show signs of pain during the period in which her daughter-in-law was recording the video. The family of the resident asked the Maryland State Department of Health and Mental Hygiene to open an investigation into the case, but the investigation reportedly did not find evidence of wrongdoing. "However, the Department did not have a copy of the video during its investigation and the family's nursing home claim lawyer subsequently provided the Department with a copy of the video and requested that the Department re-open its investigation," according to medicalmalpracticelawyers.com. "The family has indicated that they intend to seek $30 million in compensatory damages from the defendant Maryland nursing home."
