
The emergency room is the most hectic environment in a hospital. Medical negligence is possible in an emergency treatment situation, and if you suffered an injury after receiving emergency treatment, it may have been the result of medical malpractice.
The Emergency Room and Medical Malpractice
The basic criteria for establishing that medical malpractice occurred during emergency treatment are the same as any other situation. There must have existed a relationship between the doctor and patient, the treatment the patient received must have been negligent, and the patient must have been harmed as a result of this negligence. Emergency room staff are still expected to meet a certain standard of care in their treatment of patients.
In order to determine if medical malpractice was committed, expert testimony is required. Expert testimony is used to determine the standard of care that is appropriate for the situation in question, and whether or not the physician met this standard of care.
